Terms & Conditions
The Couple understands and accepts that the photographic coverage will be as the Photographer’s professional expertise determines that no one photograph will be deemed more important than another.
Photographs taken during the course of the event will be at the discretion of the Photographer although every effort will be made to comply with the Couple’s requirements.
The Photographer is limited by the guidelines of the ceremony official or the reception site management.
The couple agrees to accept the technical results of their imposition on the Photographer. Negotiation with the officials for moderation of guidelines is the Couple’s responsibility.
A non-returnable booking fee of 25% (deducted from total package price) is due when this contract is returned to secure the booking. The remaining balance is to be paid no later than four weeks before the wedding date.
Payment information for the booking fee will appear once the completed contract is submitted.
The Couple agree that failure to comply with the above payment schedule will release the Photographer from his obligations under the contract.
As verbally agreed with the Couple, the Photographer agrees to take photographs from two hours before the wedding ceremony to the end of the wedding reception. The Photographer’s whereabouts on the day will be agreed with the Couple prior to the wedding date.
The Photographer will document the events in a candid, reportage manner and take formal portraits as requested by the Couple.
The Couple should provide a full list of formal photographs required, including names and relationship to the Couple.
The package provided by the Photographer for the full contract price will consist of a personal online digital Gallery allowing the couple to download at least 300 full size, high resolution photographs (300dpi JPEG files).
The Photographer retains copyright of the photographs but allows the Couple the right to reproduce the images for personal, non-profit use only. No permission is given for the reproduction of images for commercial or profitable purposes.
The Photographer will endeavour to forward the above item to the Couple no longer than three weeks after the date of the wedding.
Please note that any alterations made to the booking by the Couple once this contract has been signed may only be made at the discretion of the Photographer and in some circumstances (such as the change of ceremony date for a wedding) the Photographer may be unable to accommodate these alterations due to a conflict of commitments. Under these circumstances the photographer is not liable to compensate the Couple.
Cancellation/ Force Majeure or Act of God:
If the Photographer has to cancel this contract for reasons beyond their control, for example including but not limited to death, injury or sickness, the Photographer’s liability shall be limited to a full refund of all monies paid, including the booking fee.
The Couple may cancel this contract anytime after it has been signed by sending written notice to The Photographer. If the written notification is received more than 121 days before the date the wedding is due to take place then The Photographer will reimburse The Client any monies paid, except for the Booking Fee.
If the written notice of cancellation is received within 120 days of the due wedding date then the amount of the price that The Photographer shall be entitled to is calculated in accordance with the table below (detailing the amount The Photographer is entitled to..
0-60 days = 100%,
61-90 days = 75%,
91-120 days = 50%,
121+ days = Booking fee
The Couple hereby allow(s) the Photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites and other such material, providing that the images used are used lawfully and without damage to the Couple.
Limitation of Liability
The Photographer shall be granted creative and artistic license in relation to the choice of locations and poses used. Judgement on photographic style and the number of photographs taken and delivered shall be deemed correct.
On its own behalf, and on behalf of the subject, The Couple acknowledges that they are familiar with The Photographer’s portfolio and are requesting services with knowledge of The Photographer’s style; that The Photographer’s work is constantly evolving; that The Photographer’s services are of unique and artistic nature; that the photos may be different from photographs taken by The Photographer in the past; and that in creating the photos.
The Photographer shall use his personal artistic judgment to create images consistent with his personal vision of the event, which vision may be different from The Couple’s and the subject’s vision of the event. Accordingly, The Couple acknowledges that the photographs shall not be subject to rejection on the basis of taste or aesthetic criteria.
The photographer will endeavour to take all the photographs agreed. However, because a wedding is an uncontrolled event, the photographer cannot guarantee delivery of any specifically requested image(s), especially if timings or events are altered without the Photographer’s knowledge.
Due to changes of the weather and the availability and willingness of subjects The Photographer will do their best to honour requested photographs but cannot undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.
During a wedding The Photographer will automatically re-take any photograph where they have seen that someone has blinked, but it is impossible to guarantee to see them all. The more people in the photograph the more difficult it is to see everyone.
The Photographer shall be the sole professional (still) photographer(s) at the venues specified. I have read and understood the above and agreed to abide by the terms of agreement set out.
